Mitchell man denies abusing infant
A Mitchell man accused of abusing an infant younger than two months old pleaded not guilty Tuesday to multiple charges.
Dale Duane Magnuson, 24, is charged with two counts of aggravated assault, each accompanied by an alternative count of abuse or cruelty to a minor.
Court documents say the alleged crimes occurred between March 21 and April 26. Magnuson was arrested May 9.
According to Mitchell Police Detective Lt. Don Everson, staff at Avera Queen of Peace Hospital notified police on April 27 after the infant was brought in with numerous injuries, including a broken femur.
Aggravated assault is a felony with a maximum punishment of 15 years in prison and a $30,000 fine. Abuse or cruelty to a minor is a felony with a maximum punishment of 10 years in prison and a $20,000 fine.
Magnuson is set to stand trial in August.
