Mitchell man arrested for third-offense DUI charge
A Mitchell man has been arrested for third-offense drunken driving.
Shawn Darrell Buffington, 39, was allegedly driving drunk when he was stopped by a Mitchell police officer for speeding around 11:53 a.m. Oct. 6 near the intersection of Second Avenue and Foster Street in Mitchell.
According to court documents, the officer noticed Buffington smelled strongly of alcohol and slurred his speech. After Buffington performed poorly on two field sobriety tests, he refused to do any more and allegedly told the officer he was too drunk to drive. Buffington was arrested for drunken driving. Because he has two prior convictions for DUI within the last 10 years, he is charged with a felony and faces up to two years in prison and a $4,000 fine if convicted.
He is also charged with speeding, driving with a suspended driver's license and open alcohol container in a motor vehicle.
Buffington is scheduled to appear in court later this month.
