Mitchell man arrested for fourth-degree rape
A 28-year-old Mitchell man is accused of having sex with a 13-year-old girl.
James Clayton Taglioli Jr. is charged with fourth-degree rape, a felony with a maximum punishment of 15 years in prison and a $30,000 fine. He was arrested March 27.
According to court documents, Taglioli is alleged to have had sex with a 13-year-old girl sometime between Feb. 11 and March 27 at a residence in Mitchell where he and the victim were living at the time.
Court documents say Taglioli admitted to authorities to having sex with the victim once during the time alleged and claims the act was consensual. Taglioli's stepsister is the victim's mother, court documents say.
State law says fourth-degree rape occurs if the victim is 13 years old, but less than 16 years old, and the perpetrator is at least three years older than the victim.
Taglioli remains in custody at the Davison County Jail with a bond set at $10,000.
Tinan, Smith and Bucher, a Mitchell law firm, has been appointed to represent Taglioli. He is scheduled to appear in court today for an arraignment.
