Marty suspect pleads not guilty to 2nd-degree murder
SIOUX FALLS -- A 23-year-old man accused of fatally shooting his uncle has pleaded not guilty to second-degree murder.
Dancing Bull Fischer made an appearance Tuesday in U.S. District Court in Sioux Falls after being indicted for allegedly killing 47-year-old Tony Fischer Sr. with an assault rifle on Nov. 27 at a trailer home near Marty on Yankton Sioux tribal land.
The indictment replaces a criminal complaint filed against Dancing Bull Fischer the day of the alleged killing.
U.S. Magistrate Judge John E. Simko advised Fischer of his rights and provided him with a copy of the indictment, after which Fischer entered his not guilty plea to a second-degree murder charge.
Fischer faces a maximum of life in prison and a $250,000 fine. He remains in custody pending future court appearances.
