Man sues city over location of lagoons
MOUNT VERNON -- A rural Mount Vernon man has filed a lawsuit against the city of Mount Vernon for building new lagoons too close to his property.
According to court documents, Dale Kroupa complained the new sewer lagoons the city is constructing have "disturbed the plaintiff's peaceful and quiet enjoyment of his property and has and will diminish the value of the plaintiff's real estate."
The civil suit also claims the city has therefore condemned Kroupa's property without just compensation.
Kroupa is seeking compensation to be determined by a jury for the unlawful taking of his property, the diminished value of the property, projected loss of income, interest and reasonable attorney fees and costs.
