The incident happened about 2 p.m. when officers were called to the 100 block of East Third Street. Andrew Spotted Elk, 25, reportedly was the guest of Matthew Dupris, 26, in his Mitchell apartment. Police say Dupris asked Spotted Elk to leave and Spotted Elk, who was intoxicated, grabbed a steak knife and cut Dupris at the base of his neck before leaving the apartment.

The arrest was made in the 300 block of North Main Street in the east alley, where officers found him walking away from the apartment.

Mitchell Police Officer Dan Fechner said officers had about two minutes of non-compliance from Spotted Elk before he was arrested and charged with aggravated assault. He said neither subject spoke of any altercation or argument that led to the incident.

The cut to Dupris' neck was about 6 inches in length, with about half of it being about a half-inch thick.

He was transported to Avera Queen of Peace Hospital and was expected to be released Sunday.

Aggravated assault carries a maximum penalty upon conviction of 15 years in prison and a $30,000 fine.
