GLAD YOU ASKED: Sidewalk wine and cigarettes?
Q. Now that voters have approved the ordinance allowing wine service on Mitchell's downtown sidewalks, will people be allowed to smoke at any outdoor cafes set up downtown?
A. There are no city ordinances that would prevent patrons from smoking at outdoor cafes downtown, even if those cafes are on public sidewalks, according to Mitchell City Attorney Carl Koch.
But, Koch said he was unsure how the state's ban on smoking in most places of employment and indoor public places, including in bars and restaurants, might apply to the situation.
Voters passed the ordinance allowing outdoor sidewalk wine service during Tuesday's election with a vote of 1,215, or 60 percent, to 826, or 40 percent. The ordinance will take effect once the results of the election are canvassed Monday by the City Council.
