Former city worker goes to jail for embezzlement

A former Mitchell city employee pleaded guilty Thursday to stealing money from the city and was sentenced to two days in jail.

Shannon Foster, 47, committed petty theft of between $400 and $1,000 from the James Valley Community Center between January and April.

Additional jail time was suspended on the condition that Foster pay restitution to the city, along with other costs and fines. She also must remain on good behavior for one year.

She was originally charged in April with grand theft for having allegedly stolen about $3,000 from the center. Local prosecutors reached a plea agreement with Foster that resulted in the lesser misdemeanor charge.

“The plea agreement was reflective of the affordable evidence,” said Jim Miskimins, Davison County state’s attorney. “I had no hesitation to enter into the agreement because it was appropriate in my eyes and that of my chief deputy.”

Mitchell Mayor Ken Tracy said he’s happy Foster pleaded guilty to something.

“I guess, considering the seriousness of the charges, I would have thought maybe prosecution for a felony would have been in order,” he said. “But I don’t know what went into the plea bargain, so I can’t comment on that.”
