MARTY -- New charges have been filed against the man accused of fatally shooting his uncle and wounding another relative Nov. 27 at a trailer home near Marty on Yankton Sioux tribal land.


A superseding indictment filed Tuesday charges 23-year-old Dancing Bull Fischer with one count of second-degree murder, one count of assault with intent to commit murder and two counts of discharging a firearm during and in relation to a crime of violence.

Fischer is accused of killing 47-year-old Tony Fischer Sr. and shooting Dominic Fischer, whose age has not been disclosed.

An affidavit by Federal Bureau of Investigation Special Agent Michael Melcher alleges Fischer used an assault rifle in the shooting.

Fischer was originally indicted Dec. 4 on a lone count of second-degree murder for the alleged killing of Tony Fischer Sr. The new indictment keeps that charge and adds assault with intent to commit murder for the alleged shooting of Dominic Fischer, as well as two additional charges for Dancing Bull Fischer's alleged use of a firearm in the incident.

Fischer, if convicted, faces a maximum of life in prison for the murder charge. He could also be punished with up to 20 years for the assault with intent to commit murder charge and a minimum of 10 years for each count of discharging a firearm during and in relation to a crime of violence.
