A simple assault charge against a bartender at Thirsty's Bar in Mitchell has been dismissed.

Judy Lynn Hall, 45, was facing one count of simple assault after she allegedly shoved a customer, Andrea Finnell, by the throat while working as a bartender at Thirsty's.

Davison County State's Attorney Pat Smith said he personally reviewed a video surveillance tape that showed the alleged incident, and he determined it did not rise to the level of simple assault.

The dismissal form was signed by Davison County Assistant State's Attorney Bob O'Keefe. The dismissal was not filed with the Davison County Clerk of Courts when The Daily Republic reported on the charge earlier this week.

Hall was arrested by a Mitchell police officer shortly after the incident occurred Feb. 19.

The Davison County State's Attorney's Office dismissed the charge Feb. 27.
